Planning Committee voted 10 to 0 on Class 4 Area for 231 Bay Street North at its Tuesday, May 26, 2026 meeting. The motion carried.

Wilson) WHEREAS, the lands located at 231 Bay Street North are near the CN shunting yards in Ward 2, which presents concerns related to noise impacts; WHEREAS, the lands located at 231 Bay Street North were not formally deemed residential, despite being occupied by residents for decades; WHEREAS, the current building will remain in place at 231 Bay Street North, but as there will be changes made to it, it will need to conform to residential building standards; WHEREAS, a “Class 4 Area” is defined by the “Environmental Noise Guideline - Stationary and Transportation Sources - Approval and Planning (NPC-300)” as an area “in proximity to existing, lawfully established stationary source(s)” (i.e. the shunting yards); WHEREAS, a Class 4 Area must receive formal confirmation from the City’s land use planning authority during the land use planning process. THEREFORE, BE IT RESOLVED: That Development Planning Staff BE DIRECTED to report back to a future Planning Committee meeting with recommendations about deeming the lands located at 231 Bay Street North, Hamilton as a Class 4 Area pursuant to the Ministry of the Environment, Conservation and Parks (MECP) Environmental Noise Guidelines NPC-300 (Stationary and Transportation Sources – Approval and Planning).
