Request for Direction to Proceed with Appeal of Committee of Adjustment Decision to Approve Minor Variance Application A-26:023 for Lands Located at 84 York Boulevard and 89 Park Street North, Hamilton (Ward 2) (Deferred from the May 5, 2026 Planning Committee meeting) (Kroetsch/Beattie) That Report PED26124, dated May 5, 2026, respecting Request for Direction to Proceed with Appeal of Committee of Adjustment Decision to Approve Minor Variance Application A-26:023 for Lands Located at 84 York Boulevard and 89 Park Street North, Hamilton (Ward 2), BE RECEIVED and the recommendations contained therein BE APPROVED: (a) That Council gives approval to the following actions, as detailed in Report PED26124, respecting Committee of Adjustment Minor Variance Application A-26:023 submitted by Bousfield Inc. c/o David Falletta, on behalf of The Trustees of Philpott Memorial Church (owners), for the lands located at 84 York Boulevard and 89 Park Street North, as shown in Appendix “A” attached to Report PED26124, approved by the Committee of Adjustment, and recommended for denial by the Planning and Economic Development Department: (i) That Council of the City of Hamilton proceed with the appeal to the Ontario Land Tribunal against the decision of the Committee of Adjustment to approve Minor Variance application A-26:023; and, (ii) That Council directs appropriate Legal Services, and Planning staff to attend the future Ontario Land Tribunal hearing in opposition to the decision of the Committee of Adjustment to approve Minor Variance application A-26:023. (b) That the written submission be received (Item 9.1(a)): (i) David Falletta, Bousfields Inc.
