The motion, as recorded in the minutes:

food and creating a community gathering destination for downtown residents and all Hamiltonians; WHEREAS, the Hamilton Farmers’ Market is collaborating with the PED Commercial Districts and Small Business Office, through the Downtown Revitalization Strategy, to pilot an activation on York Boulevard in Fall 2026; WHEREAS, the planned activation includes an outdoor seating and community gathering space containing native trees and shrubs, that aligns with the fall harvest theme; Audit, Finance and Administration Committee May 28, 2026 Minutes AFA 26-007 Page 6 of 9 Refer to the June 3, 2026 Council Minutes for the disposition of these matters. WHEREAS, the budget allocated by the Hamilton Farmers’ Market and the Commercial Districts and Small Business Office is sufficient to cover all components of this activation, excluding the supply of the native trees and shrubs; and WHEREAS, while the use of Capital Re-Investment Reserve does not fit within the Ward Specific Funding Initiatives Policy for the purpose of improving infrastructure, the native trees and shrubs will be permanently planted within Ward 2 once the project has finished. THEREFORE, BE IT RESOLVED: (a) That costs associated with native trees and shrubs for the Hamilton Farmers’ Market Fall York Boulevard Activation BE FUNDED from the Ward 2 Capital Reinvestment Reserve #108052 at an upset limit, including contingency, not to exceed $10,000; (b) That a one-time exception to the Ward Specific Funding Initiatives Policy BE APPROVED to permit use of Area Rating Reserve funds; and (c) That the Mayor and City Clerk BE AUTHORIZED to execute any required agreement(s) and ancillary documents, with such terms and conditions in a form satisfactory to the City Solicitor.
