Public Works Committee approves MOTION, As Amended, 12-0

Public Works Committee voted 12 to 0, with 2 absent on MOTION, As Amended, at its Monday, June 15, 2026 meeting. The motion carried.

The motion, as recorded in the minutes:

Council wish to advance such an approach; (d) That Council acknowledges that the current servicing arrangement does not comply with Waterworks By-law No. 23-235 and, pending completion of the staff review and reporting process, directs that the existing servicing arrangement may remain in place on an interim basis, subject to any operational or public health requirements deemed necessary by City staff to protect drinking water quality, public health, and system integrity; and, (e) That any existing or future billing, cost-sharing, or financial disputes between private property owners related to the historical servicing arrangement remain private civil matters between the affected parties, and that the City shall not assume responsibility for resolving or adjudicating such disputes. (ii) The following friendly amendment was accepted by the mover and seconder of the Motion: (a) That staff, led by Hamilton Water and in consultation with Planning and Economic Development, Legal Services, and any other appropriate City Divisions, be directed to investigate expedite the investigation into the feasibility of the City assuming ownership and responsibility for the existing 100mm private water service line extending from Mud Street East to the property line of 167 First Road East, and converting the existing private service connections to municipal service connections that comply with the requirements of Waterworks By-law No. 23-235; Public Works Committee June 15, 2026 Minutes PWC 26-008 Page 14 of 21 Please refer to the June 24, 2026, Council Minutes for the disposition of these matters.
